Section 53
Complaints can be made
(1) Except as otherwise provided in this Code, the following person may file a complaint in the court regarding any offense under Schedule-4:-
(a) A person who has been injured by a fault,
(b) Any person close to him in relation to a matter to be complained about by a national servant who is stationed elsewhere or abroad in the course of his employment,
(c) in relation to any work to be done by any person in any office, position or any other capacity, or in relation to any matter to be protected, a person in such office, position or capacity,
(d) Deaf, blind children or persons over seventy-five years of age or persons who are physically or mentally incapacitated can complain about the rights of their single-family home and any other rights or custodians if they do not have such rights,
(e) In case of damage to any organized organization due to the fault, the director or member, administrator or chief executive officer of such organization who has the right to act as the principal.
(2) When filing a complaint as per sub-section (1), the following details shall be given in the format as per Schedule-21:-
(a) the name, surname, nationality (including toll) of the accused or the defendant, age, profession or occupation, name of father, mother or husband or wife,
(b) the citizenship, passport, driver's license or other easily traceable identifying information of the accused or the defendant,
(c) The rural municipality or municipality where the accused or the defendant resides, ward no., village, toll, block no. and other particulars of the accused to the best of their knowledge,
(d) Name, surname and address of the owner of the house, if known (e) If the accused or the defendant does not have a permanent residence, the name and surname of the owner of the house where he resides,
(f) Particulars of offence,
(g) if there is more than one offense at the same time, each charge against the accused or the defendant and the evidence thereof,
(h) the relevant law to be applied and the basis thereof,
(j) the demand for the punishment to be meted out to the accused or the defendant and the basis thereof,
(j) Damages caused by the fault and damages if compensation is to be paid by the accused or the defendantAmount and basis thereof,
(k) Other essential matters.
(3) When filing a complaint according to sub-section (1), a copy of the complaint regarding the number of accused or defendant and a copy of the written evidence that the complainant wants to submit must also be submitted along with such complaint. ………………………………
